A Writ of Fieri Facias (Fi.Fa.) is a legal document issued by the court after a judgment has been entered. It allows a creditor (plaintiff) to collect money owed by a debtor (defendant).

The Seminole County Sheriff’s Office assists in the enforcement of Fi.Fa. by conducting levies on personal property when appropriate.

What is a Fi.Fa.?

A Fi.Fa. (Writ of Fieri Facias) is:

  • A court-issued document confirming a monetary judgment
  • A lien against the debtor’s property
  • A legal tool used to collect unpaid debts

This process is governed by Georgia law.

What is a Personal Property Levy?

A personal property levy is the process by which the Sheriff’s Office may:

  • Seize non-exempt personal property belonging to the debtor
  • Hold the property in accordance with legal procedures
  • Proceed with public sale (if applicable) to satisfy the debt

Requirements for Levy

Before a levy can be conducted, the following must be provided:

  • A valid, recorded Fi.Fa. issued by the court
  • Written instructions from the plaintiff or their attorney
  • A detailed description and location of the property to be levied
  • Applicable fees (see fee schedule below)

Important Information

  • The Sheriff’s Office does not locate assets on behalf of the plaintiff
  • Property must be clearly identified and accessible
  • Certain property may be exempt from levy under Georgia law
  • All actions are conducted in accordance with court orders and state law

Fees

Fees for levy services are set in accordance with Georgia law.

  • Levy fee
  • Additional costs (if applicable):
    • Storage fees
    • Advertising fees
    • Sale-related costs

Fees must be paid in advance unless otherwise specified.
